General Terms and Conditions of Sale
1. Scope
By placing an order on www.my-brandable.com you acknowledge that you have read, understood and accepted, without reserve, the present General Terms and Conditions of Sale between you and Brandable SA (hereinafter referred as “Brandable” or “we/us”). Brandable reserves the right, at any time, to modify the present General Terms and Conditions of Sale by posting a new version on its website. By placing an order after Brandable have posted a new version of its General Terms and Conditions of Sale, you agree to be bound by that updated version.
2. Registration
When you register on this website, you must ensure that the registration information you provide is correct and complete. Please inform Brandable of any change of personal details by updating them on this website without delay. When you register to use this website, you will be asked to create a password. You must keep this password confidential and not disclose it to anyone or share it with anyone. You are fully responsible for the use of your password and any orders placed under it, even without your knowledge. If you know or suspect that someone else knows or has used your password, you should notify Brandable immediately.
3. Orders
By placing an order on this website, you make an offer to purchase the products you have selected under these General Terms and Conditions of Sale. If the goods are no longer available upon receipt of the order, the order will be cancelled and you will be notified via email. You will be refunded the payment if already made in full.
4. Prices
The prices payable for the items you order are those displayed on the website on the date you place your order, inclusive of VAT for Switzerland, but exclusive of VAT for any other country and excluding delivery charges. Delivery charges will be billed at the rates indicated on this website on the date you place your order.
5. Delivery
All orders confirmed by Brandable will be delivered to the delivery address in Switzerland or other country that you specify when placing your order.
6. Return Policy
You have the right to return purchased item(s) that do(es) not suit you within 21 days after receipt of the order. Brandable will only accept returns of the item(s) in their original condition and packaging accompanied by the invoice. On receipt of the return, Brandable shall reimburse the price of the returned item(s) within a maximum of 30 days upon receipt of the returned purchase.
To initiate a return you must notify Brandable by email at help@brandable.ch, of the items being returned and the cause for return.
Return shipping is to be paid by you, unless the item being returned was broken or defective upon delivery.
In the event of a broken or defective product, the item must be returned in original condition and packaging. A full refund including shipping costs will be made to you within 30 days of receipt of the damaged merchandise.
Information regarding the statutory right to cancel:
You have the right to cancel your order.
To exercise the statutory right to cancel you must inform us by e-mail: help@brandable.ch
Please note that refunds can take up 30 days to show on your account due to varying processing times between payment providers.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
7. Payment
We accept payments via bank transfer, PostFinance cards, credit cards (Visa, MasterCard, American Express), PayPal and invoice payment for Swiss residents.
8. Limitation of Liability
The photographs and texts illustrating and describing the goods on this website are non-contractual and for information purposes only. Brandable shall not be liable in the event of errors or omissions in the photographs or texts displayed on this website. Without limiting the scope of these General Terms and Conditions of Sale, no claim of any kind, whether as to products delivered or non-delivery of products, or otherwise, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. In no event shall Brandable be liable for ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE (EVEN IF THE ADVENT OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN KNOW BY BRANDABLE), CAPABLE OF ARISING IN CONNECTION WITH ITS PRODUCTS, THEIR USE, SALE OR THIS WEBSITE.
9. Applicable Law and Jurisdiction
The present General Terms and Conditions of Sale are governed by the Swiss Law.
For the avoidance of doubt, English version of the General Terms and Conditions of Sale will prevail.
